1. Overview

These Terms of Service ("Terms") govern your access to and use of the Vunnu Sleep website and related information, content, features, tools, products and services provided by Vunnu Sleep Inc., doing business as Vunnu Sleep ("Vunnu Sleep", "we", "us" or "our") (collectively, the "Services").

By accessing or using the Services, you agree to these Terms and acknowledge our Privacy Policy. Purchases made directly from us, where available, are also subject to our Shipping & Returns policy. Purchases made through Amazon, TikTok Shop or another marketplace are also subject to the terms and policies of that marketplace. If you do not agree to these Terms, do not use the Services.

Nothing in these Terms excludes or limits rights or remedies that cannot lawfully be excluded or limited, including applicable consumer rights.

2. Eligibility and accounts

You must be at least the age of majority in the place where you live to use the Services or have the permission and supervision of a parent or legal guardian.

Where account features are available, you are responsible for providing accurate, current and complete information, maintaining the confidentiality of your account credentials, and activity carried out through your account. Contact us promptly if you suspect unauthorized use.

We may refuse, suspend or terminate access where reasonably necessary to protect the Services, our customers or our rights, or where you breach these Terms.

3. Products and website information

We try to describe and display our products accurately. Colors and appearance may vary depending on your device, display settings and lighting. Measurements and other details may be approximate unless stated otherwise.

We may change product descriptions, prices, availability and other website content at any time. This does not affect an order we have already accepted, except where we correct an obvious error or the law permits a change.

4. Orders and contract formation

Where we offer direct purchasing through the Services, placing an order is an offer to purchase. An automated order acknowledgment confirms receipt but does not necessarily mean that we have accepted the order. We accept the order when we send confirmation of acceptance or dispatch the goods, whichever occurs first.

We may decline or cancel an order for legitimate reasons, including unavailability, suspected fraud, pricing or description errors, payment failure, delivery restrictions or purchase limits. If we cancel after taking payment, we will refund the amount paid.

You must check the order details before submitting your order. Contact us promptly if you believe there is an error.

Orders placed through Amazon, TikTok Shop or another marketplace are entered into through that marketplace and may be subject to separate contract-formation, payment, shipping and return terms.

5. Prices, payment and taxes

Prices, discounts and promotions may change without notice. For direct purchases, the price and delivery charges shown when you place the order apply to that order, subject to correction of obvious errors.

Applicable taxes, delivery charges, customs duties and import charges will be shown or described where required. Unless checkout states otherwise, you are responsible for customs duties and import charges imposed by the destination country.

You represent that you are authorized to use any payment method you provide. Payment services may be supplied by third-party processors and may be subject to their own terms and privacy notices.

6. Shipping, delivery, returns and refunds

Processing and delivery estimates for direct purchases are described in our Shipping & Returns policy. Delivery dates are estimates unless we expressly agree to a guaranteed date or applicable law provides otherwise.

For consumer orders placed directly with us, risk of loss or damage remains with us until the goods are delivered to you or to a person you identify to receive them, except where applicable law provides otherwise.

Returns, exchanges, refunds, delivery issues and the 30-Night Sleep Guarantee for direct purchases are governed by our Shipping & Returns policy. Marketplace orders are also subject to the relevant marketplace's procedures.

7. Intellectual property

The Services and their content, including trademarks, trade names, text, graphics, images, designs, video, audio, software and layout, are owned by or licensed to Vunnu Sleep and are protected by intellectual-property laws.

We grant you a limited, revocable, non-exclusive and non-transferable right to access and use the Services for personal, non-commercial purposes. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, sell, license, scrape or exploit the Services or their content without our written permission, except as permitted by law.

8. Reviews, feedback and submissions

If you submit a review, suggestion, image, idea or other content, you confirm that you have the right to submit it and that it is accurate, lawful and does not infringe another person's rights.

You grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate and display that content for operating, improving and promoting the Services, subject to our Privacy Policy and applicable law. You retain ownership of your content.

We may remove submitted content that violates these Terms or applicable law.

9. Third-party services, marketplaces and links

The Services may include third-party tools, apps, payment methods, content or links, including links to marketplaces through which Vunnu Sleep products may be sold.

We do not control third-party services or marketplaces and are not responsible for their independent content, availability, privacy or security practices. Your use of them may be governed by separate terms and privacy notices.

Where you purchase Vunnu Sleep products through a third-party marketplace, the marketplace may provide payment, ordering, fulfillment, returns, customer-service or other transaction services under its own terms.

10. Privacy

Our collection and use of personal information is described in our Privacy Policy. Our service providers and third-party platforms may also process information under their own privacy notices.

11. Prohibited uses

You must not use the Services to:

• violate any law or another person's rights
• infringe intellectual-property or privacy rights
• harass, threaten, defame, deceive or impersonate another person
• transmit malware, harmful code, spam or unauthorized advertising
• collect information about others without lawful authority
• interfere with the security, integrity or operation of the Services
• attempt unauthorized access to an account, system or network
• use automated means to scrape or exploit the Services where prohibited by these Terms or law

12. Errors and availability

The Services may occasionally contain errors, inaccuracies or omissions. We may correct them and update information where appropriate. We do not promise that the Services will always be uninterrupted, secure or error-free, but this does not limit obligations or guarantees that cannot lawfully be excluded.

13. Disclaimers

To the fullest extent permitted by law, the Services are provided "as is" and "as available". We disclaim implied warranties that may legally be excluded. We do not disclaim any warranty, guarantee or statutory right that cannot lawfully be excluded, including rights relating to the quality, fitness, description and delivery of consumer goods.

14. Limitation of liability

To the fullest extent permitted by law, Vunnu Sleep and its directors, officers, employees, affiliates, agents, contractors and service providers will not be liable for indirect, incidental, special, punitive or consequential loss arising from the Services.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud or fraudulent misrepresentation, or death or personal injury caused by negligence. For consumers, we do not exclude liability for reasonably foreseeable loss caused by our breach of these Terms or failure to use reasonable care and skill.

15. Responsibility for misuse

To the extent permitted by law, you are responsible for losses reasonably incurred by us as a direct result of your unlawful use of the Services, intentional misconduct or material breach of these Terms. This section does not apply to the extent a loss was caused by us or would make you responsible for a claim that the law does not permit us to transfer to you.

16. Termination

You may stop using the Services at any time. We may suspend or terminate access if you materially breach these Terms, create a security or legal risk, or misuse the Services. Provisions that by their nature should continue after termination will survive, including intellectual-property, liability and dispute provisions.

17. Severability, waiver and assignment

If any provision is unlawful or unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue in effect.

A failure to enforce a provision is not a waiver. You may not transfer your rights or obligations under these Terms without our consent. We may transfer ours as part of a reorganization, financing, merger, acquisition or sale, provided this does not reduce non-excludable consumer rights.

18. Entire agreement

These Terms, together with the policies and notices expressly incorporated into them, form the agreement between you and Vunnu Sleep concerning the Services. They do not exclude representations or rights that cannot lawfully be excluded.

19. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles.

If you are a consumer, this choice does not deprive you of mandatory protections available under the law of the country or region where you ordinarily live, and you may bring a claim in any court available to you under applicable law.

Before starting formal proceedings, we encourage you to contact us so we can try to resolve the issue.

20. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this website with a revised "Last updated" date. Changes apply prospectively unless applicable law permits otherwise. Where required, we will provide additional notice or obtain consent.
